- When a POSH complaint is filed, can the Respondent be put on paid or unpaid leave?
- If a Respondent has resigned and is on notice period, and a POSH complaint is filed in the meantime, can the resignation be suspended till completion of inquiry?
- Alternatively, if the Respondent submits their resignation after a POSH complaint is filed, can the resignation still be suspended, and under what conditions?
If IC has to give recommendations post a POSH inquiry, can it recommend that Respondent’s Provident Fund amount be withheld? Can it recommend that the Gratuity amount may be withheld?
